Samsung gives up on iPhone 4S patent suit in Germany
Samsung has reportedly dropped a lawsuit being tried by the Mannheim Regional Court in Germany that sought to ban sales of Apple’s iPhone 4S in the region. The South Korea-based vendor had focus its complaint on a patent covering 3G communications and according to patent expert Florian Miller of FOSS Patents, Samsung has determined that Apple’s use of the technology in question is protected by a licensing agreement with Qualcomm. Samsung recently lost a preliminary bid to ban iPhone 4S sales in France, though the case will now move forward as a standard patent trial. “Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology,” Samsung said in October when it first filed its complaint in France. “We believe it is now necessary to take legal action to protect our innovation.” While Samsung has seemingly abandoned its efforts in Germany to ban iPhone 4S sales, Motorola recently scored a big win in Mannheim when a judge issued a preliminary ruling that could halt sales of the iPhone and iPad by Ireland-based Apple subsidiary Apple Sales International.
