<p>&#8220;The DOJ&#8217;s accusation of collusion against Apple is simply not true,&#8221; Apple stated in its filing, according to <em>Fortune</em>. The document continued, &#8220;The launch of the iBookstore in 2010 fostered innovation and competition, breaking Amazon&#8217;s monopolistic grip on the publishing industry.&#8221;</p>
<p>The company goes on to state that the iBookstore and Apple&#8217;s iBooks product have done a huge service for the electronic book industry rather than harm it. Amazon had a 90% share of the eBook market when Apple entered the space, but the retail giant&#8217;s share has reportedly dropped to as low as 60% since Apple launched the iBookstore in 2010.</p>
<p>&#8220;Since then customers have benefited from eBooks that are more interactive and engaging,&#8221; Apple said, proceeding to place the blame for any possible wrongdoing squarely on the shoulders of book publishers. &#8221;Just as we&#8217;ve allowed developers to set prices on the App Store, publishers set prices on the iBookstore.&#8221;</p>

<p>&#8220;The software is already under development by another nonprofit foundation called LEAP who has given Calyx the green light to be the first commercial provider,&#8221; Merrill wrote while describing his project. &#8220;The money we raise will go towards setting up a datacenter and implementing the first mass market deployment of this new Internet communications platform, and in a second stage, a mobile phone platform.&#8221;</p>
<p>The Calyx Institute is seeking $1 million in funding through crowd-funding service Indiegogo for a &#8220;bare-bones launch,&#8221; or $2 million in funding for a faster launch. &#8220;If we don&#8217;t reach our funding goal, we will use what we do raise to do as much as we can with whatever we can raise,&#8221; the entrepreneur said. &#8220;I have a lot of experience running a business on a shoe-string budget, as I started my original ISP with only $10,000 of initial funds.&#8221;</p>

<p>The United States government has filed an antitrust suit against Apple, Hachette Book Group, HarperCollins, Macmillan and Penguin alleging that the companies conspired to fix electronic book prices. <a href="http://www.bgr.com/2012/03/08/doj-threatens-apple-with-antitrust-suit-over-ebook-price-fixing/">Reports surfaced more than a month ago</a> suggesting that the Department of Justice had launched an investigation into whether or not Apple had colluded with publishers to raise the prices of eBooks sold through Apple’s iBookstore. <p>Apple is said to have helped push book publishers away from their traditional pricing model — publishers would typically charge distributors about half the cover price for an eBook — and into an &#8220;agency model,&#8221; which would let publishers set the end-user price of an eBook and Apple would take a 30% commission on each sale. This new model is said to have made it difficult for booksellers such as Amazon and Barnes &amp; Noble to compete, because they would regularly discount the prices of new books and trim margins in an effort to promote sales. Verizon Wireless announced in early December its <a href="http://www.bgr.com/2011/12/02/verizon-wireless-acquires-spectrum-from-comcast-others-for-3-6-billion/">intentions to purchase 122 AWS spectrum licenses from SpectrumCo</a>, a joint venture between Comcast, Time Warner Cable and Bright House Networks. The carrier said it plans to use the additional spectrum to build out its 4G LTE network, pending government approval of the purchase. <p>&#8220;[DOJ] guidelines require that any settlement or remedy replace the market power T-Mobile currently brings to the marketplace,&#8221; Sprint&#8217;s spokesperson for public policy John Taylor wrote on his personal blog. &#8220;Any new entity would have to create a nationwide network comparable to T-Mobile&#8217;s, which covers 97% of America&#8230; [and] offer exclusive handsets, just as T-Mobile does each year. AT&amp;T would have to divest enough T-Mobile customers to ensure that any new entity or purchaser of the assets would have the same market share T-Mobile enjoys.&#8221;</p>
<p>Wall Street isn&#8217;t so sure the divestiture will help AT&amp;T&#8217;s cause, either. &#8220;Realistically, AT&amp;T is going to take its chances in court in February,&#8221; Sanford C. Bernstein analyst Craig Moffet said. &#8220;It&#8217;s all or nothing.&#8221;</p>
<p>On November 24th, AT&amp;T <a href="http://www.bgr.com/2011/11/24/att-withdraws-fcc-application-for-t-mobile-merger/">withdrew its original application</a> from the FCC to acquire T-Mobile USA and said it will instead focus on its lawsuit with the Department of Justice, which kicks off in February, before it reapplies for the FCC&#8217;s approval of the acquisition.</p>
