Microsoft is looking to halt the import of the bookseller’s Nook slates, claiming the devices infringe three Microsoft patents. Barnes &amp; Noble argued that the patents in question are invalid because they do not cover new inventions, and the company has a new ally. Jeff Hsu, a staff attorney at the U.S. International Trade Commission, told <em>Bloomberg</em> he recommended that ITC Judge Theodore Essex rule that there is no violation by Barnes &amp; Noble. <p>Apple described the technology with an example of two runners who are working out on treadmills that feed real-time stats to their iOS devices. The two runners are then able to view one another&#8217;s current pace, distance, calories burned, heart rate, blood pressure and even blood oxygen levels.</p>
<p>&#8220;These treadmills may be located in the same building, or they may be located in different buildings, in different cities, or even in different continents,&#8221; Apple said in the filing. &#8220;In this example, media on one media player can be shared between the two treadmills. Also, data from both treadmills can be displayed on each treadmill, thus showing the users their respective standings in the competition.&#8221;</p>
<p>Interestingly enough, the patent does not reference the existing Nike+ technology, which may suggest that the company is planning to distance itself from the Oregon-based sportswear giant.</p>

<blockquote><p><strong>Antitrust: Commission opens proceedings against Samsung</strong></p>
<p>Brussels, 31 January 2012 &#8211; The European Commission has opened a formal investigation to assess whether Samsung Electronics has abusively, and in contravention of a commitment it gave to the European Telecommunications Standards Institute (ETSI), used certain of its standard essential patent rights to distort competition in European mobile device markets, in breach of EU antitrust rules. The opening of proceedings means that the Commission will examine the case as a matter of priority. It does not prejudge the outcome of the investigation.</p>
<p>In 2011, Samsung sought injunctive relief in various Member States&#8217; courts against competing mobile device makers based on alleged infringements of certain of its patent rights which it has declared essential to implement European mobile telephony standards. The Commission will investigate, in particular, whether in doing so Samsung has failed to honour its irrevocable commitment given in 1998 to the European Telecommunications Standards Institute (ETSI) to license any standard essential patents relating to European mobile telephony standards on fair, reasonable and non-discriminatory (FRAND) terms. The Commission will examine whether such behaviour amounts to an abuse of a dominant position prohibited by Article 102 of the Treaty on the Functioning of the EU (TFEU).</p>
<p>In line with the Commission&#8217;s Guidelines on standardisation agreements (see IP/10/1702 and MEMO/10/676), standard setting organisations, including ETSI, require the owners of patents that are essential for the implementation of a standard to commit to license these patents on FRAND terms. This commitment serves to ensure effective access to the standardised technology. Such commitments were given to ETSI by many patent holders, including Samsung, when the third generation (&#8220;3G&#8221;) mobile and wireless telecommunications system standards were adopted in Europe.</p>
<p>In order to guarantee undistorted competition and to reap the positive economic effects of standardisation it is important that FRAND commitments be fully honoured by the concerned undertakings.</p></blockquote>

<p>Apple has been cleared of infringing an Apple patent in one of <a href="http://www.bgr.com/?s=apple+samsung+patents">more than 30 ongoing patent complaints</a> Samsung and Apple currently have filed against each other around the world. Judge Andreas Voss of Germany&#8217;s Mannheim Regional Court on Friday ruled that the Cupertino, California-based company&#8217;s mobile devices do not infringe on a Samsung-owned patent pertaining to the UMTS standard, <em>FOSS Patents</em> reported. The court has yet to issue a ruling regarding six other patents Samsung has accused Apple of infringing in Germany. &#8221;We are disappointed that the court did not share our views regarding the infringement by Apple of this specific patent in Germany,&#8221; Samsung spokesman Nam Ki-yung told reporters. &#8220;It should be noted that today&#8217;s ruling relates to only one of several patents asserted by Samsung in the Mannheim court.&#8221;<span id="more-123431"></span></p>
