NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Promotion Period: TeleNav, Inc. (“TeleNav”) and BGR Media LLC (“BGR Media”) Podcast iPad Sweepstakes (“Sweepstakes”) will begin on June 24th, 2011 at 12:01 AM Pacific Daylight Saving Time (“PDST”) and end on July 1, 2011 at 11:59 PM PDST (“Sweepstakes Period”). The Sweepstakes consists of one (1) Apple iPad giveaway.
2. Winner Selection: Winners will be selected at random at the end of the Sweepstakes Period. Odds of winning depend on the number of eligible entries received. All entries will be screened by and validated by TeleNav. Winners will be notified by email or via a message on the BGR.com website and will be required to sign and return an affidavit of eligibility /liability release, tax form and, where legal, a publicity release within seven (7) calendar days of prize notification. In the event of non-compliance with these requirements, prize may be forfeited and awarded to an alternate winner.
Potential winners will be notified by e-mail in order to verify mailing addresses, and prizes will be shipped, where applicable. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. All prize(s) will be awarded.
3. Prizes and Approximate Retail Values: One (1) Grand prize winner will receive one (1) Apple iPad 2 16GB (voice and data plan excluded) with an Approximate Retail Value (ARV) = $499.99 (before tax).
Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use, and the reporting consequences thereof. Prizes are awarded “as is” with no warranty or guarantee express or implied by TeleNav and any Co-sponsor(s) (as defined below). TeleNav and any Co-sponsor(s) disclaim all and any liability for the actual provision, quality or nature of any third-party product or service accepted by the winners. Entrants understand that TeleNav and any Co-sponsors are not liable for injuries, losses, damages of any kind arising from participation in this Sweepstakes and acceptance, possession, and use and/or misuse of any prize. The awarding of any prize is contingent upon full compliance with these official sweepstakes rules (“Official Rules”).
4. Entries: To enter, entrants must (a) post a comment of any length or type on the applicable blog post on BGR.com and (b) download the TeleNav Navigator app (“App”) on any smartphone, where the App has not been pre-loaded on such mobile phone. To qualify, entrants do not need to download the App where a fee is associated with the download. To the extent that the App has been pre-loaded on the smartphone, or a fee is associated with the download in (b) above, entrants may in the alternative “Like” TeleNav on Facebook (www.facebook.com/telenav) in place of such download. Limit one (1) entry per person. Entries using macro, robotic, script, or other forms of automatic entry will be disqualified. Entries become the property of TeleNav and will not be returned. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook. By participating, you understand that you are providing your information to the Sponsor and Co-Sponsor, and not to Facebook. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the Facebook account. The “authorized account holder” is defined as the natural person to whom the Facebook account is assigned by Facebook. Odds of winning depend on the number of eligible entries received.
5. Eligibility: Open to legal residents of the 50 United States and the District of Columbia who have reached the age of 18 years old. Void where prohibited by law. Employees of TeleNav, Co-sponsor(s), their respective affiliates and subsidiaries (and members of an employee’s immediate family and/or those living in the same of household of each such employee) are not eligible.
6. Conditions of Participation: All entrants must have a valid e-mail address, and it is entrant’s responsibility to update TeleNav of any change in e-mail address. Expenses not specifically included in the prize description and all taxes are the sole responsibility of the winner. No substitution, assignment, cash equivalent or transfer of prizes is permitted, except by TeleNav, who reserve the right to substitute a prize with another prize of comparable or greater value, at its sole discretion. All federal, state, provincial, and local laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of TeleNav, which are final and binding on all matters pertaining to this Sweepstakes. All entrants may be required to sign any documents necessary to transfer copyright of the entry to TeleNav within seven (7) days following the date of first attempted notification. Submission of an entry constitutes permission for TeleNav and its agencies to use the entrant’s name and/or likeness, biographical material, and/or entry (including an altered form of the entry) for advertising and promotional purposes without additional compensation, unless prohibited by law. Each entrant by participating in this Sweepstakes agrees on his/her own behalf (and on behalf of his/her heirs, assignees, executors and administrators) to release TeleNav and any Co-sponsor(s) and hold them harmless from and against any and all liability, loss or damage of any kind resulting in whole or in part, directly or indirectly, from his/her participation in this Sweepstakes or any Sweepstakes-related activity or from the award, acceptance, possession, misuse or use of any prize or participation in any prize-related activity.

7. Internet: TeleNav is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by TeleNav on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. TeleNav reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes. Any attempt by an entrant or other person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, TeleNav reserves the right to seek damages from any such entrant or person to the fullest extent of the law.
8. Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Santa Clara, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits, may be awarded (collectively, “Special Damages”); and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California state law, without reference to California’s choice of law rules, governs the Sweepstakes and all aspects related thereto.
